Mediation is an alternative conflict resolution mechanism, where an accredited, well trained, neutral third party assist conflicting parties to settle their conflict by reaching a mutually accepted settlement, which is legally binding. Mediation, compared to court driven litigation is quick, cost effective, less formal, mostly outside court and confidential.

Mediators are trained professionals with the highest international ethical standards. Mediators do not represent one specific client and should not have had contact with either of the parties prior to the mediator , being called upon. The Mediator operate in the shadow of the law; the must know the law and ensure that all aspects of any settlement complies with the laws, under which a specific case is mediated.

We, at “The Mediator”, offer specialist services focusing on Family law; Divorce, Maintenance and Parenting plans. Other personality conflicts such as which may occur at the work place, social clubs, churches, schools, sectional title communities and families, can also be mediated and resolved with the co-operation of the parties.

Since 9 March 2020, Rule41A of the court rules, makes it compulsory for all parties in any type of conflict, to first attempt mediation. In the event of mediation not being possible, the mediator submits a certificate jointly with all parties to the conflict, to court, before litigation can be pursued. Even then,  a judge can rule that mediation must be followed. While parties are in mediation all other court processes if any are put on hold.

Costs are determined by the complexity and duration of a case. We can quote a “flat rate” with a time limit or hourly rates. Normally the costs of mediation is split equally between the parties.
